THQ Files Suit Against Activision Over Baja Box Art

THQ has filed suit against mega-publisher Activision Blizzard, alleging that the box art used for Baja 1000 The Official Game bares an overly strong resemblance to THQ’s recently released offroad rally racer Baja: Edge of Control.

THQ asserts that the box artwork for Activision’s game is “virtually identical,” further pointing out that the similarity is likely to cause considerable confusion amongst consumers.

According to the suit, which was filed earlier last week, THQ has made several attempts to contact Activision to rectify the issue but to no avail. Which is why the company is now resorting to legal action.

Does THQ have a case here? Game-related suits pop up all the time and while majority of them have little merit, this one surprisingly does. The two pieces of box art are similar in style and could very well mislead consumers into believing that Activision’s Baja title is a follow-up based on THQ’s franchise.
