Konami Sues MTV Parent Viacom Over Rock Band

Oh dear. Japanese-based publisher Konami has filed suit against MTV parent Viacom, asserting claims of patent infringement. The company alleges that Harmonix’s Xbox 360 and PlayStation 3 title Rock Band violate a series of patents issued in 2002 and 2003, which refer to simulated musical instruments.
For those out of the loop, Konami announced its own Rock Band-esque game earlier this year, entitled Rock Revolution.
According to the filed complaint, Konami is demanding cash compensation, in addition to an order that would effectively block Viacom and Harmonix from using the patented inventions.

Why hasn't Konami sued Activision/Red Octane for the Exact same thing (especially since there's how many Guitar Heros out and Konami has like what several diffrent Guitar and Drum Kit games in the Archades already since 2000/2001)??? unless they already paid the royalties.
Or is it because Konami has decided to bring those types of games to the Consoles and is doing the exact thing MTV is doing by bringing the full "rock band" setting to their up comming game. It's kind of like all those other big Corps that want to get rid of the competition.
