3D Realms Hit With Suit Over Earth No More

Two California residents, namely Darin Scott and Edward Polgardy of Cinemagraphix Entertainment, have filed a copyright suit against Duke Nukem developer 3D Realms.

The suit pertains to Earth No More, a game 3D Realms announced back in June 2007. The two men claim to have pitched the idea for Earth No More to numerous game companies, including 3D Realms, in early 2005.

Apogee Software, Earth No More development partner Recoil Games of Helsinki, Finland and Action Entertainment are named as defendants in the suit, which seeks maximum damages allowed under the US Copyright Act.
