Capcom In Legal Battle Over Dead Rising Scenario

Over the past year or so, the MKR Group has been up in arms over the scenario used in Capcom’s Xbox 360 title Dead Rising, which takes place in an abandoned mall infested with zombies. Why? MKR Group claims to own exclusive rights to George A. Romero’s 1979 film and 2004 remake, “Dawn of the Dead,” which coincidentally, features the same scenario as in Dead Rising.

Talks between the MKR Group and Capcom have broken down, with MKR asserting claims for copyright and trademark infringement against Capcom, Microsoft and Best Buy based on marketing and distributing of Dead Rising.

In response, Capcom has filed a complaint, contending that “humans battling zombies in a shopping mall” is a “wholly unprotectible idea” under existing copyright standards.
